You must be at least 18 years of age and legally capable of entering into binding contracts to use our Services. By using the Services, you represent and warrant that you meet these requirements.
Hospitality partners who integrate with DirectGuest's systems must complete our onboarding process and provide accurate, current information. You are responsible for maintaining the confidentiality of any access credentials provided and for all activities that occur under your account. Notify us immediately at hello@directguest.ai if you suspect unauthorized access.
You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not:
DirectGuest facilitates bookings between guests and hospitality venues. We are not a party to the reservation contract between guest and property. All booking terms, cancellation policies, and room rates are set by the individual property. DirectGuest does not guarantee availability, pricing accuracy, or the performance of any hospitality partner.
Disputes related to a specific reservation should be addressed directly with the relevant property.
Our LLM-powered applications are designed to assist in the booking process but may occasionally produce inaccurate or incomplete information. You should verify critical booking details directly with the property before completing a reservation. DirectGuest is not liable for errors arising from AI-generated responses.
All content, trademarks, logos, software, and technology comprising the Services are the property of DirectGuest or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Services for their intended purpose. No rights are granted beyond what is expressly stated here.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. DIRECTGUEST DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIRECTGUEST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICES SHALL NOT EXCEED THE GREATER OF $100 USD OR THE AMOUNT PAID BY YOU TO DIRECTGUEST IN THE TWELVE MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless DirectGuest and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
Our Services integrate with third-party platforms including social media networks, property management systems, and AI infrastructure providers. Your use of such platforms is governed by their respective terms of service. DirectGuest is not responsible for the practices or content of third-party services.
We reserve the right to modify these Terms at any time. We will indicate the date of the most recent revision at the top of this page. Your continued use of the Services after any changes constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
